Recording and Replay Policy
Version 2026-10-09 · Effective October 6, 2026 · XSTATIC ENTERTAINMENT, INC. (California, USA) · 2dcd003c7ab2
1. The default: nothing is recorded
Sessions are not recorded by default. Live audio and video pass through our video provider and are not stored unless a recording is made for that session under this policy: when a User has paid for a recording and the Pro's recording setting allows it (Section 2), or when someone asks in the session and everyone agrees. Free Intro sessions are never recorded.
2. When a one-to-one session may be recorded
All of these must be true:
- The Pro's recording setting allows it. Each Pro chooses a setting — never, audio only, or audio and video. "Never" means the session cannot be recorded through the Platform. Allowing recording is the Pro's agreement, given in advance, to a recording a User has paid for (item 3).
- The category allows it. Some categories — including health and legal consultations — are switched off for recording regardless of the Pro's policy.
- Everyone in the session agrees, in one of two ways. In advance, for a recording a User paid for: if a User has bought the recording-and-replay add-on (Section 4) and the Pro's setting allows the scope (audio, or audio and video), the User agreed by buying it and the Pro agreed in advance through their setting. The Pro is not asked again in the session. The recording starts once both are in the session and any other participant has agreed. In the session, for any other recording: when someone starts a recording, every other participant is asked, in the session, and told what would be recorded (audio, or audio and video) and how long it is kept. Nothing is recorded until everyone has agreed. One person's agreement is never enough.
- The recording is indicated while it runs ("REC"), to everyone in the session, including invited participants. When a recording starts on the Pro's setting, the Pro is told in the call that it has started, and can stop it there.
Where a minor participates under the guardian model, recording follows the guardian-consent rule and fails closed otherwise.
3. How consent works
- Declining is always allowed, is never penalized and does not cancel or shorten the session. A Pro may not make a recording a condition of the session.
- Withdrawing. Anyone may stop recording themselves at any time ("Stop recording me"); recording stops. The part already recorded is kept under this policy unless you ask us to delete it (Section 7). When a Pro stops a recording, their advance agreement ends for the rest of that session: it does not start again unless the Pro agrees in the session.
- Someone joins later. A recording continues only among people who agreed; when a person who has not agreed joins the room, the recording stops until they are asked and agree.
- Overtime and extra time. A recording that is running continues through courtesy overtime and through extra time the Pro accepts (Add Time), without a new request; it ends when the session ends or someone stops it.
- Your own recording is not allowed. Do not record, screen-record, photograph, screenshot or transcribe a session or another participant with your own device or any other tool. Many places, including California, require every party's consent to record a confidential communication; recording without it can be a crime and grounds for damages, and it is grounds for removal from ProsAccess.
4. Paid recording and replay
Where the Pro and the category allow it, a User can buy a recording-and-replay add-on with the booking or during the session, on the web (it is not sold in the iPhone app). Its price is shown when you buy it. One add-on covers the whole session; stopping and restarting never charges again. Buying it is the User's agreement to be recorded, and the Pro's recording setting is the Pro's agreement given in advance (Section 2): the recording starts once both are in the session. Anyone else in the session is still asked, and anyone can stop the recording. If no recording is made, the add-on is refunded in full. The add-on is platform revenue, outside the Pro's share, and cannot be bought on a Free Intro.
5. Group Sessions
A host may record their Group Session. Where recording is enabled it is disclosed on the session page before you book ("Recorded") and in the room. There is no individual opt-out in a recorded Group Session: attendees are not on camera unless invited on stage; if you do not want your voice or picture captured, do not go on stage or do not join. When the session ends, every seat holder receives a replay link for the replay period, for personal viewing only. The Group Session chat is not part of the recording; it is a separate text thread shown beside the replay and in Messages to the host and seat holders for 30 days after the session ends (see Group Sessions).
6. Who can access a recording, and for what
- Replay of a one-to-one session is available only to the person who paid for the recording-and-replay add-on, signed in, on the web, for 7 days after the session, through a page that checks the entitlement each time. A replay bought on the web plays on the web, not in the iPhone app; the app shows how to watch it there. The Pro and the other participants cannot watch it. The replay of a Group Session is available to the host and the seat holders for 7 days. Replay links are not public storage links. Replay is for personal viewing only: do not download outside a feature we provide, re-publish, post, sell or share a recording.
- Reviewing a report or dispute. A small number of authorized staff may access a recording to investigate a report, dispute, safety concern or policy violation; every access is logged.
- Law. We preserve and disclose a recording where the law or lawful process requires, or to prevent serious harm.
We will not use recordings, transcripts, sessions or messages for marketing, sell them, disclose them to advertisers, use them to train machine-learning models, or use them for ranking, recommendations or personalization.
7. Retention and deletion
Recordings are deleted 7 days after the session, automatically. A recording is kept beyond that only while a report, dispute, review challenge or legal obligation places a hold on it; the hold is released when the matter closes. Non-content session records (who joined, when, for how long, connection quality) are kept for the periods in Section 8 of the Privacy Policy — 90 days, longer while a session issue, chargeback or legal claim is open, and for paid bookings the transaction and connection metadata for the card-network dispute period. You may ask us to delete a recording of a session you took part in (support@prosaccess.com); we delete it unless a hold applies, and tell you which. A copy that someone with replay access saved through a Platform feature (a download) is on their device and outside our control.
8. Transcription
Transcription is not offered today. If we offer it, transcripts will be treated exactly like recordings under this policy and the provider will be named in the Privacy Policy before any transcript is made.
9. Misuse
Recording someone without consent, redistributing a recording, or using one to harass, threaten, embarrass or extort is a serious violation: immediate removal, and a report to law enforcement where appropriate. If a recording of you has been misused, tell us at support@prosaccess.com.
10. Changes
Material changes take effect on notice as described in the Terms. The version in force at the time of a session governs that session's recording.
